1.Estimates and Expenses

The estimate enclosed sets out the services we agree to supply.
This estimate is an indication of the charges likely to be incurred on the basis of the information and details we know at the date of the estimate.
While we make every effort to ensure the accuracy of the estimate, the charges are liable to alteration particularly where third parties change their rates or charges.
Payment for expenses to third parties is required prior to the funeral taking place.

2. Terms of Payment

Payment due 1 calendar month from date of invoice.
Disbursements are to be paid at the time of arranging the funeral.
Payment in full is required for direct and essential funerals prior to the funeral taking place.

3. Charging of Interest on Overdue Accounts

We reserve the right to charge interest on any account not paid according to our Terms of Payment.
This will be at the rate of 4% above our bank’s base rate per month or part month overdue.
Interest will be added to statements and any interest due and unpaid will be left as an outstanding overdue balance.

4. The Right to Charge Collection Costs on Overdue Accounts

We reserve the right to add to any overdue account the costs incurred by us in collecting the account through a third party acting on our behalf.

5. Standards of Service

The National Association of Funeral Directors Code of Practice requires that we provide a high quality service in all aspects. If you have any questions or concerns about the service we provide to you, please raise them in the first instance with our designated senior person. If that does not resolve the problem to your satisfaction the National Association of Funeral Directors, through NAFD Resolve, provide a dispute resolution service.

6. Defective Products/Services and Consequential Loss

Any claim by the Buyer or his Agents for compensation for defective goods or services shall be limited to the actual cost of those goods or services.
No liability will be accepted in any way for any consequential loss or damage resulting from those goods or services however caused.

7. Subsidiary Clauses

a. We reserve the right to alter or amend these Terms and conditions from time to time.
Where an alteration is made, a new copy of the Terms and Conditions will be sent which will then become
the current Terms and Conditions and becomes legally binding.

b. Should any clauses contained in these Terms and Conditions be held invalid, such invalidity will not
affect the validity of the remaining clauses.

c. These Terms and Conditions shall be subject to and be construed in accordance with English law.

8. Data Protection

H. Porter & Sons may collect, store and use the following information:
Title, name, address, telephone numbers, email addresses and photographs.

The information may be shared with the following parties to assist us in providing services to you:
Crematoria, doctors, cemeteries, burial grounds, grave diggers, ministers of religion, celebrants, churches, verges, wardens, florists, caterers, charities and anybody also assisting with funeral provision.

We do not allow our third party service providers to use your personal data for their own purpose.
We only permit them to process your personal data for specified purposes in accordance with our instructions.
We may use the information you provide to improve our products and services.
Your information will be kept as long as necessary for the purposes you gave us instruction for and will be kept securely.
